Parra v. Gillaspie Construction Inc. and Johnson Excavation, Inc., appellate case 18CA0800. Plaintiffs sought more than $1,400,000 in damages and interest related to perceived defects in the construction of their multi-million dollar Steamboat Springs, Colorado home. They claimed defective construction resulted in periodic differential movement of the structure. Plaintiffs alleged the movement caused distress throughout the home including cracks in the drywall, cracks in the tile floors, separation at the fireplace hearth, kitchen backsplash pulling away from the wall, gaps and cupping of the hardwood flooring, etc. However, based on information learned during discovery, we fought the plaintiffs’ claims through a summary judgment motion he filed with the Court. The Court agreed with the firm’s analysis and dismissed the entire action.

• Following dismissal of the case, plaintiffs appealed the matter to the Colorado Court of Appeals. The Colorado Court of Appeals issued its opinion in March 2019 affirming the lower court ruling.
