Bailey v. GEICO Casualty Company, civil action 2018CV032557, El Paso County District Court. Plaintiff was involved in a motor vehicle accident. Plaintiff had previously signed a rejection of underinsured motorist coverage under his insurance policy and had not paid any premium for this coverage. However, Plaintiff filed a lawsuit and requested that his insurance contract be reformed after the fact to include underinsured motorist coverage. After Karen Wheeler and Jami Maul conferred with Plaintiff’s counsel regarding a motion to dismiss that they intended to file, Plaintiff agreed to dismiss all claims against GEICO.
