Court Agrees that $6,000/hr. Deposition Rate is Unreasonable

June 2017 Prince v. Justus, Civil Action 16CV31544, El Paso District Court. Plaintiff disclosed physician’s assistant Phillip Falender, PA-C as one of his expert witnesses.  Mr. Falender sought a deposition rate of $6,000 per hour.  The court agreed with Mr. Waters that the reasonable rate for Mr. Falender’s deposition was $35 per hour. Ultimately, Mr. Falender testified in his deposition that he had not expressed any relatedness or causation opinions.
